Terms of Service

1. Agreement to terms

These Terms of Service govern your access to and use of Photoset.ai. By creating an account, buying credits, uploading photos, training a model, or generating images, you agree to these terms.

If you do not agree, do not use Photoset.ai.

2. Eligibility

You must be at least 18 years old to use Photoset.ai. By using the service, you represent that you are 18 or older and that you will not upload or generate sexualized, exploitative, or otherwise prohibited content involving minors.

3. Accounts and security

• You must provide accurate account information.
• You are responsible for protecting your account credentials.
• You are responsible for activity under your account.
• Contact support@photoset.ai if you believe your account has been compromised.
• Do not create multiple accounts to bypass limits, suspensions, billing controls, or safety systems.

4. The service

Photoset.ai lets users create AI-generated photoshoots by using fictional demo subjects, stock/demo models, or personalized AI models trained from uploaded photos with consent.

• Tokens: generation uses tokens. A standard image currently costs 5 tokens, and a 4-photo shoot costs 20 tokens.
• Training credits: one training credit trains one personal subject when the required consent, age, upload, and payment checks pass.
• Subscriptions: paid plans renew according to the Stripe checkout terms shown at purchase. You may cancel according to the billing flow available in your account or through support.
• Refunds: failed training or generation may be refunded automatically where the app detects that work did not complete. Other payments are non-refundable except as required by law or expressly stated.

5. Acceptable use

You may use Photoset.ai to create lawful personal or commercial images, subject to these terms and applicable law.

You may not use Photoset.ai to:

• Upload photos of another person without explicit permission and rights to use those photos.
• Upload or generate content involving minors, sexual exploitation, nudity involving minors, or child sexual abuse material.
• Create non-consensual intimate images, sexual deepfakes, harassment, blackmail, impersonation, or deceptive content.
• Target celebrities, public figures, private people, employees, customers, or lookalikes in a way that violates rights or misleads others.
• Generate illegal, hateful, violent, defamatory, fraudulent, or abusive content.
• Circumvent moderation, billing, rate limits, security, or account enforcement.
• Scrape, reverse engineer, resell, or use Photoset.ai to train competing models without permission.

6. Photo uploads and biometric consent

Before training a personal subject, you must confirm that you are 18+, that the photos are yours or are used with explicit written permission, and that Photoset.ai may process facial geometry to create a personalized AI model.

Training reference photos are deleted after training completes. Personalized model weights remain until the subject/account is deleted or applicable retention limits are reached. You may revoke consent by deleting the subject or account.

7. Ownership and license

You retain ownership of photos you upload and generated images you create, subject to applicable law and third-party rights. You are responsible for how you use and publish generated images.

You grant Photoset.ai a limited license to store, process, moderate, display, and deliver your uploaded photos, model data, and generated images solely to operate the service and provide requested features.

We do not use your uploaded photos or generated images to train general-purpose AI models.

8. Moderation and enforcement

Photoset.ai may use automated and human review to detect unsafe, illegal, infringing, or policy-violating content. Content may be blocked, removed, quarantined, refunded, or escalated for review.

Violations may result in warnings, token/credit loss where appropriate, account suspension, account termination, or reporting to authorities when legally required.

DMCA or rights notices can be sent to legal@photoset.ai.

9. Account termination

You may close your account through account settings or support. We may suspend or terminate accounts that violate these terms, create safety risk, commit fraud, or abuse the service.

After account closure, generated images, model weights, and user-owned data are deleted according to the Privacy Policy and operational retention limits. Billing records may be retained as required by law.

10. Disclaimers and liability

Photoset.ai is provided “as is.” AI generation may fail, produce unexpected results, or require retries. We do not guarantee uninterrupted operation, specific output quality, likeness accuracy, or fitness for a particular purpose.

To the fullest extent allowed by law, Photoset.ai is not liable for indirect, incidental, consequential, special, or punitive damages. Our total liability for any claim is limited to the amount you paid to Photoset.ai in the 12 months before the claim, unless applicable law requires otherwise.

11. Governing law and changes

These terms are intended to be governed by the laws of British Columbia, Canada, unless final legal review selects a different governing jurisdiction or applicable consumer law requires otherwise.

We may update these terms. Material changes will be posted here and, where appropriate, sent by email. Continued use after changes take effect means you accept the updated terms.
